Action Technologies, Inc. (Action Tech) appeals the order of the United States District Court for the Northern District of California granting Novell Systems, Inc.s (Novells) motion for summary judgment of invalidity of Action Techs U.S. Patent No. 5,216,603 (the `603 patent). See Action Techs., Inc. v. Novell, Inc., No. C-95-4093-VRW, 1997 WL 337577 (N.D. Cal. June 5, 1997). For its part, Novell cross-appeals the district courts earlier order granting summary judgment of infringement in favor of Action Tech. See Action Techs., Inc. v. Novell, Inc., No. C-95-4093-VRW (N.D. Cal. Dec. 3, 1996). We affirm the grant of summary judgment of invalidity and do not reach the issue of infringement.
